1. Acceptance of These Terms

By accessing BrightMindshop.com or purchasing any product from BrightMind Company (“BrightMind,” “we,” “our,” or “us”), you acknowledge that you have read, understood, and agreed to be bound by these Terms & Conditions and by our Privacy Policy. If you do not agree, please do not use the Site or place orders.

2. Definitions

“Site” means BrightMindshop.com and any sub‑domains.
“Products” means science‑related physical goods listed for sale.
“Customer” / “you” means any person or entity that browses, orders, or purchases Products from the Site.

3. Products & Orders

3.1 All Products are sold subject to availability.
3.2 We reserve the right to refuse or cancel any order (e.g., suspected fraud, stock errors, pricing inaccuracies).

4. Pricing & Payment

4.1 Prices are listed in Kuwaiti Dinar (KD).
4.2 Accepted payment methods: KNET, credit card, and Apple Pay via MyFatoorah.
4.3 Payment is captured in full at checkout.

5. Returns & Refunds

5.1 Unused items in their original condition and packaging may be returned within 14 days of delivery.
5.2 Returns are free: our driver collects the item at no cost to the Customer.
5.3 Damaged or wrong items must be reported within 48 hours of delivery with a photo; we will replace or refund them at no cost.
5.4 Used items cannot be returned, including started experiment kits (such as the Crystal Garden), a used Suture Practice Kit, and dug-out Dig-Out & Discover kits.
5.5 Refunds are issued to the original payment method within 7 business days after we receive the return. Full details are in our Refund Policy.

6. Product Safety

Some Products contain small parts, chemicals, or sharp tools. Always follow the included safety instructions and supervise children during use. BrightMind is not liable for misuse.

7. Intellectual Property

All Site content including text, graphics, logos, images, and Product designs is the property of BrightMind or its licensors and is protected by Kuwaiti and international IP laws. You may not reproduce, distribute, or create derivative works without our prior written consent.

8. User Accounts & Data

8.1 You may check out as a guest or create an account. You are responsible for maintaining the confidentiality of your login credentials.
8.2 We collect and process personal data (e.g., name, email, phone, address) for order fulfillment and marketing, in accordance with our Privacy Policy.
8.3 You may unsubscribe from marketing emails at any time.

9. Disclaimer of Warranties

Products are provided “as is” except where otherwise stated by the manufacturer. To the maximum extent permitted by law, we disclaim all implied warranties.

10. Indemnity

You agree to indemnify and hold BrightMind harmless from any claim, demand, or damage arising out of your breach of these Terms or your misuse of the Site or Products.

11. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Kuwait. Any dispute that cannot be resolved amicably shall be submitted to the exclusive jurisdiction of the courts of Kuwait City.

12. Changes to Terms

We may update these Terms from time to time. Changes take effect when posted on the Site. Continued use after any modification constitutes acceptance.
